# Terms of Service for CycleCare: Period Tracker

## 1. Acceptance of Terms

Welcome to CycleCare: Period Tracker ("CycleCare," "the App," "we," "us"). By downloading, installing, or using CycleCare, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

CycleCare is developed and operated by Adev, a solo developer.

## 2. Description of Service

CycleCare is a menstrual cycle tracking application designed to help women track their periods and receive general informational facts. The app provides:

Period and cycle tracking
- General cycle predictions based on your tracking data (informational only)
- Symptom and mood logging
- Pattern summaries and general facts
- Reminders and notifications
- Data export functionality

IMPORTANT: CycleCare is NOT a medical device, NOT a medical app, and is NOT intended to diagnose, treat, cure, or prevent any disease or medical condition. This is a tracking tool that provides general informational facts only. CycleCare does NOT provide medical advice.

### Not Medical Advice
- CycleCare provides personal tracking tools and general informational facts only
- The App does NOT provide medical advice, diagnosis, or treatment of any kind
- All predictions, insights, and information are for informational and tracking purposes only
- Always seek the advice of qualified healthcare professionals for ANY medical concerns
- Never disregard professional medical advice or delay seeking it because of information from CycleCare
- CycleCare information and predictions are general facts based on typical patterns and your tracking data - they are NOT medical recommendations

### Not for Contraception
- Do not rely on CycleCare as your sole method of birth control
- Fertility predictions are estimates and may not be accurate
- CycleCare is not designed or intended for contraceptive purposes
- Consult healthcare providers about appropriate contraception methods

### Not a Fertility Treatment
- CycleCare can help track fertility windows but does not guarantee conception
- If you are trying to conceive, consult fertility specialists
- Cycle irregularities may indicate underlying health conditions requiring medical attention

### Emergency Situations
- If you experience severe pain, abnormal bleeding, or other concerning symptoms, seek immediate medical attention
- CycleCare is not for medical emergencies

## 4. Eligibility and Age Requirements

### Age Restrictions
- You must be at least 12 years old to use CycleCare
- Users under 13 may require parental consent depending on jurisdiction
- Users under 18 should use CycleCare with parental knowledge

### Capacity
- You must have the legal capacity to enter into these Terms
- By using CycleCare, you confirm you meet these requirements

## 5. Account Registration and Security

### Account Creation
- You may use CycleCare with or without creating an account
- With account: Your data is backed up to the cloud
- Without account: Your data remains only on your device

### Account Security
- If you create an account, you are responsible for maintaining its security
- Use a strong password and enable PIN/biometric lock
- Notify us immediately of any unauthorized access at support@adevtech.com
- You are responsible for all activities under your account

## 6. Your Data and Privacy

### Data Ownership
- You own all your cycle data, symptoms, and health information
- You grant us a limited license to store and process your data solely for providing the service
- This license terminates when you delete your data or account

### Privacy Protection
- Your menstrual health data is sensitive personal information
- We treat it with the highest level of security and privacy

- We will never sell your health data

### Data Accuracy
- You are responsible for the accuracy of data you enter
- We do not verify the accuracy of your tracking information
- Inaccurate data may result in inaccurate predictions

## 7. Prohibited Uses

You may not use CycleCare to:
- Violate any laws or regulations
- Share another person's health information without consent
- Attempt to hack, disrupt, or compromise the App's security
- Use automated systems (bots) to access the App
- Reverse engineer or decompile the App
- Resell or redistribute the App or its features
- Use the App for any medical, diagnostic, or therapeutic purpose without professional guidance
- Rely on the App as a contraceptive method

## 8. Prediction Accuracy and Limitations

### Algorithm Limitations
- Cycle predictions are based on algorithms and your personal tracking history
- Predictions are estimates and may not be accurate
- Accuracy improves with more data but is never guaranteed
- Irregular cycles, life changes, and health conditions affect accuracy

### No Guarantees
- We do not guarantee:
- Accurate period predictions
- Accurate fertility window calculations
- Accuracy of any health insights or patterns
- Prevention of unexpected periods or pregnancy

### Your Responsibility
- Use predictions as estimates only
- Plan accordingly with buffer time
- Verify predictions with your own observations
- Consult healthcare providers for important decisions

## 9. Subscription and In-App Purchases

### Free Version
CycleCare offers a free version with basic features:
- Basic period tracking
- Simple cycle predictions
- Limited symptom tracking
- Basic reminders

### Premium Subscription
Premium features include:
- Advanced predictions and fertility tracking
- Unlimited symptom tracking
- Detailed health insights and analytics
- Custom reminders and notifications
- Data export (unlimited)
- Ad-free experience
- Priority support

### Pricing and Billing
- Subscription pricing is displayed in the app
- Prices are in your local currency
- Subscriptions auto-renew unless canceled 24 hours before renewal date
- You will be charged through your App Store or Google Play account
- Payment is charged at confirmation of purchase

### Cancellation and Refunds
- Cancel anytime through your App Store or Google Play account
- Cancellation takes effect at the end of the current billing period
- Refunds are handled by Apple App Store or Google Play Store according to their policies
- Contact their support within 14 days for refund requests
- No partial refunds for unused portions of subscription periods

## 10. Reminders and Notifications

### Notification Services
- You can enable reminders for period predictions, ovulation, medications, etc.
- We are not liable for missed, delayed, or failed notifications
- Notification delivery depends on:
- Device settings and permissions
- Network connectivity
- Operating system functionality
- Battery optimization settings

### No Critical Reliance
- Do not rely solely on CycleCare reminders for critical health needs
- Use additional reminder systems for important medications or appointments
- We are not responsible for consequences of missed reminders

## 11. Data Export and Portability

### Export Functionality
- You can export your cycle data to PDF or CSV at any time
- Premium users have unlimited exports
- Free users may have limited export frequency

### Exported Data Usage
- Exported reports are for personal use and medical appointments
- Do not share exported data containing personal health information publicly
- You are responsible for securing exported files

### Medical Records
- CycleCare exports are not official medical records
- Healthcare providers may not accept CycleCare data as clinical documentation
- Consult your healthcare provider about their data requirements

## 12. Intellectual Property

### App Ownership
- CycleCare, including its code, design, algorithms, features, and branding, is owned by Adev
- These Terms grant you a limited, non-exclusive, non-transferable license to use the App
- You may not copy, modify, distribute, or create derivative works of the App

### Trademarks
- "CycleCare" and the CycleCare logo are trademarks of Adev
- You may not use our trademarks without written permission

### User Content
- You retain ownership of data you input into CycleCare
- You grant us a license to store and process your data as described in the Privacy Policy

## 13. Third-Party Services

CycleCare uses third-party services (Firebase, Google Cloud Platform) that operate under their own terms of service:

We are not responsible for the practices of third-party services.

## 14. Disclaimers and Warranties

### "As Is" Service
CycleCare is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy, reliability, or completeness of predictions or health insights
- Error-free or uninterrupted operation
- Security of data transmission or storage
- Suitability for medical, contraceptive, or fertility purposes

### Prediction Disclaimers
- Cycle predictions are estimates based on algorithms and may be inaccurate
- Fertility window calculations are approximations and should not be relied upon for contraception
- Health insights are for informational purposes only and are not medical advice

### Device Compatibility
- We do not guarantee CycleCare will work on all devices
- Features may vary by device and operating system
- We may discontinue support for older devices or OS versions

## 15. Limitation of Liability

To the fullest extent permitted by law:

### No Liability For
- Inaccurate predictions or fertility calculations
- Missed reminders or notifications
- Unintended pregnancies resulting from reliance on fertility predictions
- Medical complications or health issues
- Data loss, corruption, or breaches
- Consequences of medical decisions made based on CycleCare data
- Third-party service failures (Firebase, App Stores, etc.)

### Maximum Liability
- Our total liability shall not exceed the amount you paid for CycleCare in the past 12 months
- For free users, our liability is limited to $25 USD or equivalent

### Exclusions
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Including but not limited to: lost profits, lost data, personal injury, or emotional distress

## 16. Indemnification

You agree to indemnify and hold harmless Adev from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of CycleCare
- Your violation of these Terms
- Your violation of any rights of another party
- Reliance on CycleCare for medical, contraceptive, or fertility purposes
- Data you input or share through the App
- Medical decisions made based on CycleCare data

## 17. Termination

### By You
- Stop using CycleCare and delete your account at any time
- Use the in-app account deletion feature or contact support@adevtech.com
- Deleting the app without deleting your account will not delete your cloud data

### By Us
We may suspend or terminate your account if:
- You violate these Terms
- You engage in prohibited activities
- Required by law or regulation
- You engage in abusive behavior toward our team

### Effect of Termination
- Upon termination, your right to use CycleCare ceases immediately
- We may delete your data after termination (see Privacy Policy for retention periods)
- Paid subscriptions are non-refundable upon termination for violations

## 18. Changes to Terms

We may modify these Terms at any time. Changes will be effective upon:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Sending an in-app notification (for material changes)
- Emailing you (if you provided an email)

Continued use of CycleCare after changes constitutes acceptance of the new Terms.

## 19. Governing Law and Disputes

### Governing Law
These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

### Dispute Resolution
- Informal Resolution: Before filing any claim, contact us at support@adevtech.com to attempt informal resolution
- Time Limit: Disputes must be brought within 1 year of the issue arising
- Individual Claims: No class action lawsuits or class-wide arbitration

### Arbitration (if applicable)
- Disputes may be subject to binding arbitration

- You may opt out of arbitration within 30 days of accepting these Terms

## 20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

## 21. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Adev regarding CycleCare.
